A 42-year-old Indian man has died in hospital two weeks after his arrest in Australia. The incident is being treated as a death in custody.

Gaurav Kundi was arrested in the early hours of May 29, 2025, in Adelaide. He “became unresponsive” during the arrest and was taken to Royal Adelaide hospital, where he died on June 13.

Police said at a press conference:

“Mr Kundi passed away as a result of the incident at Royston Park.”

South Australian police confirmed a formal investigation into the incident. The state’s major crime investigation branch will examine the cause and circumstances of Gaurav’s death. A report will be prepared for the coroner.

The Office for Public Integrity is providing independent oversight. A commissioner’s inquiry was launched on June 3.

His wife Amritpal Kaur said an officer drove their neck into Gaurav’s neck during the arrest. His head was also allegedly slammed into a police vehicle and then onto the road.

Police said the use of restraints would be closely examined as part of the inquiry.

A senior officer has already reviewed the body-worn video and a statement said:

“It has been confirmed that at no time was a knee applied to Mr Kundi’s neck.

“His head was not forced into the car or roadway at any point.

“However, the use of restraints during this incident will be closely examined during the Commissioner’s Inquiry.”

Police also said all officers directly involved in the arrest had activated body cameras. One camera detached during the incident.

“They endeavoured to position that camera while it was still operating but separated from the officer so it would continue to record.”

South Australian police have briefed the Indian consulate and will continue to share updates.

Foreign Minister Penny Wong was asked whether the incident could damage Australia’s relationship with India.

She replied: “I would say to the Indian community here in Australia and the broader Indian community, this is an investigation that will be done properly.

“Be assured of our friendship certainly with India, but also the importance of the Indian diaspora here in Australia.”

Multicultural Affairs Minister Anne Aly said public confidence in authorities must be protected.

“Trust between people of migrant background and the institutions that govern them, including the police is something that contributes to social cohesion.”
