A nursing home housekeeper from New York has been indicted for the rape of a female 81-year-old resident at his workplace who was suffering from dementia.

On December 23, 2021, New York Attorney General Letitia James announced the indictment of 51-year-old Khadka Pradhan, of Rochester, who previously worked at the Shore Winds Nursing Home.

Pradhan was charged with first and second-degree rape, first and second-degree criminal sexual act, and endangering the welfare of an incompetent or physically disabled person in the first degree.

Attorney General James said:

“The charges outlined in this case are as heinous and disturbing as they come.

“Mr Pradhan allegedly raped an elderly woman with dementia at the nursing home where she lived – grossly violating her, other residents, and her family, who trusted that she would be safe and cared for.

“The idea that one of our most vulnerable could be so severely abused and taken advantage of is a real shock to the conscience.

“But make no mistake: We will go after anyone who commits such horrific crimes and hold them accountable to the fullest extent of the law.”

Pradhan was working at the nursing home on Beach Avenue on September 29, 2021, when he entered the victim’s room at around 6:30 am.

And “through the use of forcible compulsion”, he sexually assaulted the elderly woman.

Pradhan was arrested that same day.

Bill Gargan, a prosecutor with the Monroe County District Attorney’s office, said:

“The reason we have the investigation is because of the quick-witted action and response of an employee and employees of the home.”

Pradhan was arraigned on the felony complaint in Rochester City Court on September 30, 2021, and he pleaded not guilty.

His bail was set at $10,000 cash, $50,000 secured bond, and $100,000 unsecured bond which he posted that same day.

Following his charges, the indictment will be scheduled in a Monroe County Superior Court for arraignment on a date that will be set by the court.

After Pradhan was arrested, Shore Winds Nursing Home said the housekeeper was immediately suspended and banned from the facility.

In a statement at the time, the facility’s representative said:

“The Shore Winds Nursing Home is fully cooperating and supporting local authorities regarding an alleged incident.”

Mr Gargan added: “It’s self-evidently a disturbing set of allegations, one in which we look forward to doing the best job we can to bring justice to this victim and to anybody similarly situated so that there’s a recognition that this behaviour is criminal for a reason.”

If convicted of the charges, Pradhan faces up to 25 years in prison.
