‘Bully’ & ‘Criminal’ Uncle allegedly Murdered by Nephew

A man who is accused of murdering his uncle told police his relative was a “bully” and a “criminal” who spent time behind bars.

Jurors heard a “bully uncle” allegedly murdered by his nephew was a “criminal” who had served time in prison.

Annib Khan said his uncle Mohammed Osman Khan “picked on” him for 10 years before being fatally stabbed.

Annib claimed the feud grew so serious he had to leave the Midlands for his “safety”.

Wolverhampton Crown Court heard a restraining order was imposed on Mohammed, forbidding contact with his nephew.

After his arrest, Annib said he had received “death threats” and ‘genuinely’ feared for his life.

He claimed: “Abuse from my uncle took a huge toll on my health.”

Prosecutors allege he stabbed his uncle in the neck with a 13.5cm kitchen knife.

In a prepared statement, Annib said: “My uncle was in prison for attempted murder.

“Our problems began when he was released in 2014. My grandmother entrusted me with responsibilities, which he didn’t like.

“My uncle was often arrested for crimes. He brought drugs into the house, so my grandmother told him to leave.”

Annib moved in with his grandmother, worsening tensions.

Mohammed “smashed” his car windows, stole the vehicle and once tried to “run him over”. Police allegedly advised Annib to move to London as it was “not safe” for him to stay in Dudley.

Annib said: “My uncle would pick on me. He would abuse me.”

After the restraining order ended, Mohammed allegedly returned to his grandmother’s house to intimidate him.

Annib said his grandmother stopped him from reporting further incidents to the police, saying:

“He is my son, let it go.

“I suffered for years. It took a huge toll on my mental health. I was constantly looking over my shoulder.”

On the day of the alleged murder, Annib said he saw Mohammed at Netherton Islamic Trust mosque, where his uncle called him a “shameless individual” and invited him to fight.

When Annib returned to his car, Mohammed threatened:

“I’m gonna come round later today. I’m gonna kill you.”

Annib then went to Buffery Road and told his wife and grandmother what had happened.

Once home, Mohammed’s son Zayn Khan allegedly ran in and attacked him. Mohammed reportedly grabbed a metal bar and hit Annib on the head.

Annib said: “I could feel my blood pouring. I believed I was going to die.

“They said, ‘It’s over, you’re dead’. I was thinking about my pregnant wife and elderly father in the house. I genuinely feared for all of us.”

Annib said he grabbed a knife from near the sink to “scare” them and told them to leave.

He claimed they dragged him towards the front door. During a struggle, the knife allegedly made contact with Mohammed.

Annib said:

“As soon as it happened, I ran inside, collapsed on the kitchen floor and passed out.”

He later said: “I was extremely saddened to hear my uncle had died. This was never my intention. I acted in self-defence.”

Annib was treated in hospital for a 5cm head wound and a fractured leg.

Prosecutor Kevin Hegarty KC said Annib was “bullied” by Mohammed for years. Annib allegedly pushed Mohammed into his van before stabbing him and later stabbing Zayn as he left the house.

An “axe or hatchet” and knife were found in Mohammed’s van, though prosecutors said Mohammed did not carry a weapon into the property.

Annib, of New Road, Netherton, denies murdering Mohammed, wounding Zayn with intent, and having a bladed article.

Zayn, of Warren Hall Road, Dudley, denies affray.

The trial continues.
