A Delhi court has ordered the lodging of an FIR against the son of Mithun Chakraborty after rape and cheating charges were lodged by a Bhojpuri actor.

Mithun Chakraborty’s Son Mahaakshay Accused Of Rape

"The actor has fraudulently caused physical, emotional and mental loss to the complainant."

The son of Bollywood actor Mithun Chakraborty, Mahaakshay Chakraborty, has been accused of rape and cheating charges by a Bhojpuri actress.

On 2nd July 2018, a Delhi court ordered the lodging of an FIR against Mahaakshay, known as Mimoh, and who is also an actor.

Under the FIR report, Mahaakshay faces charges of rape, cheating and causing miscarriage without consent.

The court has also requested that Delhi police probe a criminal intimidation charge against Mithun’s wife, Yogita Bali, for allegedly threatening the complainant.

According to Zee News, the actress filed a plea before the court alleging that Mahaakshay entered into a physical relationship with her by making false promises about marrying her in the future.

In May 2015, the complainant stated that she had met Mahaakshay and that he had called her to his flat. She added that during this time he became ‘physical’ with her while she was dizzy.

The actress claimed that she became dizzy after having a soft drink that the actor supplied her with, which was allegedly laced with a “stupefying substance”.

Additional Chief Metropolitan Magistrate (ACMM) at the Rohini courts, Ekta Gauba, asked the Begumpur police to lodge the FIR following the complaint by the actress. The ACMM said:

“Keeping in view that the actor has established physical relation with the complainant by administering alcoholic/stupefying substance in the soft drink offered to her, the offence of rape was committed when there was no consent as complainant was given sedative.”

Further reports suggest that the actor also cheated on the complainant and continued their physical relationship for a number of years on the pretext of marrying her. The ACMM continued:

“This shows that the actor has fraudulently caused physical, emotional and mental loss to the complainant. So, the actor has fraudulently caused injury/harm to the complainant on her body, mind and reputation. Thus, prima facie, offence of cheating, punishable under IPC Section 417 [cheating] is made out.”

Furthermore, the actress alleged that she had become pregnant and was asked to abort the foetus by the actor when she told him.

Despite the actress wanting to keep the child, Mahaakshay Chakraborty allegedly administered some ‘medicine’ to her which led to a miscarriage. The ACMM said this about the allegation:

“This shows prima facie, that an offence under Section 313 [causing miscarriage without woman’s consent] of the IPC is made out.”

The woman also claimed that Mahaakshay’s mother, Yogita Bali, threatened her with “dire consequences” if she did not end the relationship. The actress added that she had moved from Mumbai to Delhi as she “feared for her life”.

In December 2017, it is thought that the complainant spoke to Mahaakshay about his promise to marry her. Mahaakshay reportedly said he would try to convince his parents, however, he later refused because their horoscopes did not match.

Despite the serious accusations placed against Mahaakshay and his mother, the actor is reportedly set to tie the knot on 7th July 2018.

Chakraborty will marry model and actress Madalsa Sharma. Reports state that the wedding, which will be a destination wedding, will be a low-key affair, with only close family and friends attending the celebratory event.

The couple dated for close to two years before becoming engaged in March 2018 at Mithun Chakraborty’s residence in Malad, Mumbai.

The mother of the soon-to-be bride, Sheela Sharma, opened up about the wedding, saying that the families have known each other for a very long time and had initiated the relationship. She said:

“It’s going good. All are very excited we are keeping it a little low-key affair because we wanted to be it a family affair. It’s a destination wedding I can’t reveal the place – but for sure it’s not in Mumbai.

“Well so many publications write so many things. Our families knew each other since a very long time. Our parents have been associated and worked together. Families took the first call and then we took our relationship ahead. So, you can say it’s an Arrange-cum-Love Marriage in our case.”

Mahaakshay has yet to respond to the allegations of rape and cheating. Now, with the FIR lodged by the unnamed actress against him and his mother, it remains to be seen whether the wedding will go ahead.
